These Terms of Service ("Terms") govern your use of the Topstoreea website located at www.topstoreea.com (the "Site"), including all related pages, products, software, downloads, content, features, tools, and services (collectively, the "Services").
Throughout these Terms, "Topstoreea", "we", "us", and "our" refer to Topstoreea, operating the Topstoreea store.
By accessing the Site, purchasing a product, downloading software, creating an account, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
SECTION 1 - ELIGIBILITY AND ACCOUNT
1.1 You must be at least the age of majority in your place of residence to use the Services or make purchases from the Site.
1.2 You agree to provide accurate, current, and complete information during checkout, account registration, and any support requests.
1.3 You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
1.4 You may not transfer, sell, share, assign, or license your account to any other person without our prior written consent.
SECTION 2 - DIGITAL PRODUCTS AND SERVICES
2.1 Topstoreea sells digital trading software and related content, including but not limited to MetaTrader 4 ("MT4") and MetaTrader 5 ("MT5") Expert Advisors ("EAs"), bots, indicators, presets, setup guides, documentation, and related downloadable files.
2.2 Unless expressly stated otherwise on a product page, all products are delivered electronically only. No physical goods are shipped.
2.3 Product pages, descriptions, screenshots, performance examples, backtests, testimonials, and other marketing materials are provided for general informational and promotional purposes only. They do not form a guarantee of performance, profitability, compatibility, or fitness for your specific use.
2.4 We reserve the right to modify, discontinue, replace, or update any product, feature, or offering at any time.
SECTION 3 - ORDERS AND ACCEPTANCE
3.1 By placing an order, you are making an offer to purchase a digital product or service.
3.2 We reserve the right to accept, reject, limit, or cancel any order at our sole discretion, including where fraud, unauthorized transactions, pricing errors, or suspected abuse are involved.
3.3 Your order is not accepted until payment has been successfully processed and we make the digital product available to you.
3.4 If we cancel an order after payment is received, we will issue an appropriate refund for the cancelled order.
SECTION 4 - PRICING AND PAYMENT
4.1 All prices are shown on the Site and are subject to change without notice.
4.2 Prices do not include taxes, duties, levies, or similar government charges unless expressly stated otherwise at checkout.
4.3 You agree to provide valid and current billing and payment information and authorize us and our payment processors to charge the full amount due for your order.
4.4 We are not responsible for fees charged by your bank, card issuer, payment processor, broker, or any third party in connection with your purchase.
SECTION 5 - DIGITAL DELIVERY
5.1 Purchased products are delivered electronically by download link, customer account access, email, or another delivery method identified on the Site or at checkout.
5.2 Delivery is deemed completed when the product, download link, license file, or account access is first made available to the email address or customer account used for the purchase.
5.3 You are responsible for providing a correct email address and for checking spam, junk, promotions, and other filtered folders.
5.4 If you do not receive access within 24 hours after confirmed payment, you must contact us at support@topstoreea.com.
5.5 We are not responsible for delays caused by payment review, internet outages, incorrect customer information, email filtering, broker restrictions, platform issues, or events outside our reasonable control.
SECTION 6 - LICENSE AND PERMITTED USE
6.1 Subject to your compliance with these Terms and full payment, Topstoreea grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use the purchased product for your own internal personal trading use only, unless a product page expressly states broader rights.
6.2 Purchase of a product does not transfer ownership of the software, source code, strategy logic, branding, documentation, or any intellectual property rights.
6.3 Unless expressly allowed by us in writing, you may not:
(a) resell, redistribute, sublicense, rent, lease, lend, share, publish, or otherwise make any product available to any third party;
(b) copy or reproduce the product except as reasonably necessary for authorized installation and backup;
(c) modify, adapt, translate, reverse engineer, decompile, disassemble, or attempt to derive source code, trade secrets, or strategy logic from the product;
(d) remove, alter, or obscure any copyright, trademark, watermark, licensing, or proprietary notices;
(e) use the product for any unlawful purpose or in violation of any broker, prop firm, platform, marketplace, or regulatory rules applicable to you.
6.4 Unless a product page expressly states otherwise, licenses are for one purchaser only and may not be shared across unrelated users, teams, communities, signal groups, or commercial resale channels.
6.5 We reserve the right to suspend support, disable access where technically possible, or terminate licenses for breach of these Terms.
SECTION 7 - COMPATIBILITY, UPDATES, AND SUPPORT
7.1 You are responsible for ensuring that you have the required hardware, software, internet access, MetaTrader version, broker environment, symbol format, VPS, permissions, and technical knowledge necessary to use the product.
7.2 We do not guarantee compatibility with every broker, prop-firm rule set, symbol naming convention, pricing feed, spread environment, leverage setting, execution model, plugin, operating system, or third-party service.
7.3 Any setup instructions, installation guidance, FAQs, or support responses are provided on an informational basis only.
7.4 Unless expressly stated otherwise, support is limited to reasonable assistance with installation, activation, and troubleshooting of the delivered file. Support does not include custom development, account management, risk management, optimization services, remote administration, or financial advice.
7.5 If a product page states "Unlimited Updates" or similar wording, that means updates to the same purchased product, if and when released by us, at no additional charge. It does not mean:
(a) guaranteed update frequency;
(b) lifetime support without limits;
(c) major rewrites or entirely new products; or
(d) updates required because of changes made by third parties outside our control.
SECTION 8 - TRADING RISK AND NO INVESTMENT ADVICE
8.1 All products sold by Topstoreea are software tools only.
8.2 Nothing on the Site or in any product description, chat, email, support response, screenshot, example, backtest, optimization report, statement, social media post, or testimonial constitutes financial, investment, legal, tax, accounting, or brokerage advice.
8.3 Trading forex, CFDs, commodities, indices, crypto, and other financial instruments involves substantial risk and may result in the partial or total loss of capital.
8.4 We do not guarantee profitability, win rates, drawdown limits, broker execution quality, funding success, account growth, or suitability for your specific objectives.
8.5 Past performance, historical testing, simulations, and examples are not reliable indicators of future results.
8.6 You are solely responsible for:
(a) evaluating whether any product is appropriate for your needs;
(b) testing products on demo or low-risk environments before live use;
(c) setting risk controls, including lot size, stop-loss, and account protections;
(d) monitoring your trading account and open positions; and
(e) complying with any laws, regulations, broker rules, or prop-firm rules applicable to you.
SECTION 9 - REFUNDS
9.1 Because our products are digital and access is generally provided immediately or shortly after purchase, all sales are generally final once delivery has occurred.
9.2 However, nothing in these Terms limits any non-excludable rights you may have under applicable law.
9.3 If you experience:
(a) a duplicate payment;
(b) a delivery failure caused by us that we do not cure within a reasonable time; or
(c) a materially defective delivered file that we cannot repair or replace within a reasonable time,
we may, at our discretion and where appropriate, provide support, a replacement, store credit, or a refund.

SECTION 10 - INTELLECTUAL PROPERTY
10.1 The Site and all content and materials made available through it, including software, source code, compiled code, text, graphics, logos, product names, icons, videos, images, layout, design, documents, and downloads, are owned by or licensed to Topstoreea and are protected by intellectual property laws.
10.2 "MetaTrader", "MT4", and "MT5" are trademarks of their respective owners. Reference to such platforms does not imply affiliation, endorsement, sponsorship, or approval by MetaQuotes or any broker unless expressly stated.
10.3 All rights not expressly granted in these Terms are reserved by Topstoreea.
SECTION 11 - USER FEEDBACK AND SUBMISSIONS
11.1 If you send us feedback, suggestions, ideas, testimonials, reviews, or other submissions, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, publish, display, adapt, and distribute that content for business purposes, subject to applicable law.
11.2 You represent that any submission you provide is accurate, lawful, and does not infringe the rights of any third party.
SECTION 12 - PROHIBITED USES
You may not use the Services:
(a) for any unlawful, fraudulent, abusive, or deceptive purpose;
(b) to interfere with or disrupt the Site or servers;
(c) to copy, scrape, spider, harvest, or extract data from the Site using bots, scripts, crawlers, or automated means without our prior written permission;
(d) to bypass or attempt to bypass access controls, licensing controls, security features, or anti-abuse systems;
(e) to upload malicious code, viruses, worms, or harmful files;
(f) to impersonate another person or misrepresent your affiliation;
(g) to violate the rights of Topstoreea or any third party.
We may suspend or terminate access if we believe you have violated these Terms.
SECTION 13 - THIRD-PARTY SERVICES AND LINKS
13.1 The Site may reference or integrate third-party platforms, payment processors, broker services, charting tools, VPS providers, messaging apps, or external websites.
13.2 We do not control and are not responsible for third-party services, websites, content, or policies.
13.3 Your use of third-party services is at your own risk and subject to the third party's terms and policies.
SECTION 14 - DISCLAIMER OF WARRANTIES
14.1 TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES, SITE, PRODUCTS, DOWNLOADS, SOFTWARE, CONTENT, AND SUPPORT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
14.2 WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
14.3 WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
(a) THE SITE OR PRODUCTS WILL BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE;
(b) ANY SOFTWARE WILL OPERATE WITH EVERY BROKER, PROP FIRM, VPS, DEVICE, OPERATING SYSTEM, OR VERSION OF MT4 OR MT5;
(c) ANY DEFECTS WILL ALWAYS BE CORRECTED;
(d) ANY PRODUCT WILL BE PROFITABLE OR SUITABLE FOR YOUR NEEDS; OR
(e) ANY FILE OR DOWNLOAD WILL BE FREE OF ERRORS CAUSED BY THIRD-PARTY PLATFORMS OR ENVIRONMENTS.
SECTION 15 - LIMITATION OF LIABILITY
15.1 TO THE FULLEST EXTENT PERMITTED BY LAW, Topstoreea AND ITS OWNERS, AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES.
15.2 THIS INCLUDES, WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS, LOSS OF DATA, LOSS OF TRADING OPPORTUNITIES, ACCOUNT LOSSES, LIQUIDATION, MISSED ENTRIES OR EXITS, BROKER COSTS, CHARGEBACK COSTS, OR OTHER COMMERCIAL LOSSES ARISING OUT OF OR RELATED TO THE USE OF OR INABILITY TO USE THE SITE OR PRODUCTS.
15.3 TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.
15.4 SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
SECTION 16 - INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Topstoreea and its affiliates, owners, officers, directors, employees, contractors, licensors, and service providers from and against any claims, liabilities, losses, damages, judgments, costs, and expenses, including reasonable legal fees, arising out of or related to:
(a) your use or misuse of the Services or products;
(b) your breach of these Terms;
(c) your violation of any law, regulation, broker rule, or third-party right; or
(d) any content, data, or materials you submit to us.
SECTION 17 - TERMINATION
17.1 We may suspend or terminate your access to the Services, your account, or any license granted under these Terms at any time if we reasonably believe you have violated these Terms, engaged in fraud or abuse, or created risk for us or other users.
17.2 Sections relating to intellectual property, trading risk, disclaimers, limitation of liability, indemnity, governing law, and any provisions that by their nature should survive, will survive termination.

SECTION 19 - CHANGES TO THESE TERMS
